These Terms of Use (hereinafter « CGU ») define the terms and conditions of access and use of the website accessible at https://tam-7.com hereinafter the « Site »), published by TAM 7 srl, a private limited liability company under Belgian law, BCE 1019310642, whose registered office is located at Quai des Usines 160, 1000 Brussels (hereinafter « TAM 7 »).

Access to and browsing of the Site implies full, complete and unreserved acceptance of these Terms by any user (hereinafter the « User »). If you do not accept these conditions, please refrain from using the Site.


Article 1 — Purpose and scope of application

These Terms are intended to define the conditions and terms under which Users access and browse the Site.

They apply to any natural or legal person accessing the Site, whether a consumer within the meaning of Article I.1, 2° of the CDE or a professional within the meaning of Article I.1, 1° of the CDE.

These Terms govern only the use of the Site. The contractual conditions applicable to TAM 7's services are governed by the Terms and Conditions of Sale (TCS) , available on the Site.


Article 2 — Description of the Site and its features

The purpose of the Site is to:

  • Present the activities, skills and achievements of TAM 7 srl

  • Inform visitors about the services offered (renovation, electrical, acoustics, sustainable energy, logistics, assembly)

  • Allow visitors to contact TAM 7 via a contact form

  • Allow visitors to request a personalized quote

The Site is available in French and English. In the event of a discrepancy in interpretation between the two versions, the French version prevails for all users, regardless of their language or country of residence.


Article 3 — Access to the Site

3.1 Conditions of access

The Site is freely accessible to any User with internet access. All costs related to access to the Site (internet connection, computer equipment) remain the sole responsibility of the User.

3.2 Availability

TAM 7 strives to ensure the availability of the Site 24/7, but does not guarantee continuous and uninterrupted availability. TAM 7 reserves the right to suspend, interrupt or limit access to the Site at any time, in particular for maintenance, updating or security operations, without notice and without this incurring its liability.

3.3 Technical requirements

The User is solely responsible for the quality and compatibility of their computer equipment and internet connection. TAM 7 disclaims any liability for any malfunction related to the User's equipment or connection.


Article 4 — Intellectual property

All elements of the Site are the exclusive property of TAM 7 srl or are subject to a license granted to TAM 7, and are protected by copyright (Law of June 30, 1994, as amended) and Book XI of the CDE.

The following are strictly prohibited without the prior written permission of TAM 7:

  • Any reproduction or representation, in whole or in part, of the Site or any of its elements

  • Any modification, adaptation or translation

  • Any commercial exploitation of the elements of the Site

  • Any mass downloading or automated extraction (scraping) of data from the Site

  • Any act of infringement within the meaning of Articles XI.293 et seq. of the CDE

Article 5 — Use of the contact form

5.1 User commitments

By using the contact form available on the Site, the User undertakes to:

  • Provide truthful, accurate, complete and up-to-date information

  • Not impersonate any natural or legal person

  • Not transmit illegal, defamatory, insulting, obscene or violent content

  • Not use the form for unsolicited commercial prospecting (spam) within the meaning of Art. XII.13 CDE

  • Not transmit files containing viruses or any other malicious program

5.2 Processing of requests

TAM 7 undertakes to process legitimate requests as quickly as possible (generally within 2 to 5 working days) but does not commit to a response time and cannot be held responsible for the lack of response to an incomplete or illegitimate request.

The data collected via the form is processed in accordance with the Privacy Policy available on the Site.


Article 6 — Prohibited conduct

It is strictly forbidden for any User, subject to civil and/or criminal prosecution:

  • To access all or part of the Site without authorization

  • To attempt to compromise the security of the Site (DDoS, SQL injections, XSS, phishing)

  • To introduce or disseminate viruses, Trojans or ransomware

  • To carry out unauthorized automated extraction of data from the Site (scraping)

  • To infringe the intellectual property rights of TAM 7 or third parties

  • To use the Site for fraudulent purposes or contrary to public order

  • To disrupt the operation of the Site or hosting servers

These offenses may be prosecuted under the Belgian law of November 28, 2000 on computer crime (amended by the law of February 15, 2022), Articles 550bis to 550ter of the Belgian Criminal Code, and Book XII of the CDE.


Article 7 — Limitation of TAM 7's liability

7.1 Informational content

The information published on the Site is provided for informational purposes only, without guarantee of completeness or suitability for a particular use. TAM 7 disclaims any liability for any decision made based on the information available on the Site.

7.2 Indirect damages

Within the limits permitted by mandatory Belgian law, TAM 7 cannot be held responsible for indirect, immaterial, consequential or punitive damages resulting from the use or inability to use the Site, including loss of data, loss of business or damage to reputation

7.3 Third-party sites

TAM 7 exercises no control over third-party sites accessible via links on the Site and disclaims any liability for their content, availability or security.

ℹ These limitations do not apply to damage caused intentionally or by gross negligence of TAM 7, to bodily injury, nor to mandatory legal rights of consumers (art. VI.83 et seq. CDE), in accordance with art. 5.236 of the new Belgian Civil Code which prohibits exoneration for fraud or gross negligence.


Article 8 — Data protection and cookies

TAM 7 processes Users' personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Belgian law of July 30, 2018.

Article 9 — Consumer rights

In accordance with Book VI of the CDE transposing Directive 2011/83/EU, Users who are consumers benefit from all the legal protections attached to their status, which prevail over any clause of these Terms that would be less favorable to them.

Any clause creating a manifest imbalance between the rights and obligations of the parties to the detriment of the consumer is deemed unwritten, pursuant to Article VI.83 of the CDE.


Article 10 — Modification of the Terms

TAM 7 reserves the right to modify these Terms at any time. The modified Terms come into force as soon as they are published on the Site.

For any substantial modification affecting consumer rights, TAM 7 undertakes to notify Users by a visible notice on the Site with a notice period of thirty (30) days before the modifications come into force, allowing consumer Users to take note of the changes and exercise their rights.

Continued use of the Site after the expiry of the notice period constitutes acceptance of the new Terms.


Article 11 — Applicable law and jurisdiction

These Terms are governed exclusively by Belgian law.

In the event of a dispute, the parties undertake to attempt prior amicable resolution under the conditions described in the Legal Notices.

Failing this, the dispute shall be submitted to the competent courts of the judicial district of Brussels (registered office of TAM 7 srl), subject to mandatory rules of jurisdiction applicable to consumers.


Article 12 — Severability

If any clause of these Terms is declared null, unlawful or unenforceable by a competent court, such nullity shall not affect the other provisions, which shall remain in full force and effect.
